Při provádění díla postupuje zhotovitel samostatně a není při určení způsobu provedení díla vázán pokyny objednatele, ledaže se k jejich plnění výslovně zavázal. Postupuje-li samostatně, nese ovšem rizika s tím spojená. Pokud by postupoval podle pokynů objednatele, měl by je ovšem posoudit v rámci odborné péče, kterou lze na něm žádat.

During an execution of a work, a maker acts separately and they are not bound by instructions of an employer, unless they oblige explicitely to fulfil them. If they execute it separately, they bear the linked risks. If they execute the work according to the instructions of the employer, they should evaluate the instructions within an expert care, which can be required.
