Nájem je v občanském zákoníku upraven v ustanovení § 2201 – 2325. V otázkách nájmu je vždy především uváděno, že pojmovými znaky nájmu je přenechání věci jiné osobě, a to dočasně a za úplatu. Věc může být pronajata na dobu určitou i neurčitou. Pokud doba není ve smlouvě uvedena vůbec, pak platí, že jde o nájem na dobu neurčitou. Text pojednává o nájmu obecně, o nájmu bytu a nájmu domu, nájmu družstevního bytu a nájmu služebního bytu. Pojednává též o nájmu prostoru sloužícího k podnikání, pronájmu věcí movitých a o nájmu dopravního prostředku. Ustanovením o ubytování na přechodnou dobu (např. v hotelovém zařízení či studentské koleji) se již pojednání nevěnuje.

The lease is regulated in the Civil Code in the provisions of § 2201 - 2325. In the case of lease it is always stated above all that the conceptual characteristics of the lease is the abandonment of the thing to another person, temporarily and for a fee. The thing can be rented for a definite or indefinite period. If the period is not stated in the contract at all, then it is an indefinite lease. The text deals with the lease in general, the lease of an apartment and the lease of a house, the lease of a cooperative apartment and the lease of a service apartment. It also deals with the lease of space for business, rental of movable assets and rental of means of transport. Provisions on temporary accommodation (eg in a hotel or student dormitory) are no longer dealt with.
