Právo stavby je věcným právem k cizímu pozemku. Je vždy dočasné. Nelze zřídit na dobu delší než 99 let. Vydržením se nabývá na dobu 40 let. Jde o oprávnění stavebníka mít na cizím pozemku stavbu, která již existuje, nebo stavbu, která bude teprve v budoucnu zřízena. Přitom je umožněno zřídit právo stavby i k sousednímu pozemku, má-li to posloužit k lepšímu využívání stavby.
In English
The right construction is a right in rem to a foreign land. It is always temporary. It can not be established for more than 99 years. The duration is 40 years. It is the right of the builder to have on a foreign land construction, wich already exists or construction, wich will only be established in the future. In addition it is possible to have the right of construction to the neighboring land, if it is to serve to better use of the construction.
